It is allowed for an employer to ask me about my disability during a job interview?

The employer is not allowed, during the pre-contractual negotiations or otherwise in preparation for the conclusion of an employment contract, including in a job ad or during an interview, request information from the person applying for a job in which he or she has no legitimate interest. All questions that are not specific to the job are not justified. Therefore, there is no obligation to provide information on disability or about family members with disabilities when applying for a job.

Absence of a legitimate interest on the part of the employer is presumed, in particular, in matters of disproportionate importance to the private life of the person applying for a job or not related to the suitability of the job offered. The Constitution of the Republic of Estonia also protects the inviolability of family and private life.

The purpose of a CV that is presented upon applying for a job is to inform the potential employer of the suitability of the candidate for the job offered. The provision of information can be based on the requirements established in the job ad, and only such information should be provided that verify compliance with these requirements. Education, career, previous experience, etc.
