Is it appropriate to ask a person during a job interview why his or her name and appearance are conflicting?

Everyone has the right and freedom to express his or her identity in a way that suits best for him or her and, therefore, nobody should be treated unequally. Gender identity is one of the most private spheres of a person’s private life. The identity and educational documents of a candidate may contain information that does not correspond to the candidate’s gender identity. Furthermore, there may be a woman who is not a transgender person but dresses like a man simply because she feels like it.

For this reason, the employer’s questions concerning a person’s gender identity are inappropriate during a job interview. The employer should be guided by the assumption that only such questions that are strictly necessary may be asked.
