Everyone has the right and freedom to express his or her identity in a way that suits best for him or her and, therefore, nobody should be treated unequally. Gender identity is one of the most private spheres of a person’s private life. The identity and educational documents of a candidate may contain information that does not correspond to the candidate’s gender identity. Furthermore, there may be a woman who is not a transgender person but dresses like a man simply because she feels like it.
For this reason, the employer’s questions concerning a person’s gender identity are inappropriate during a job interview. The employer should be guided by the assumption that only such questions that are strictly necessary may be asked.
If you did not find an answer to your concern, you may contact the Estonian Commissioner for Gender Equality and Equal Treatment in a free format by sending an email to email@example.com. When contacting the Commissioner, the identity of the person shall not be disclosed and, upon request, anonymity shall be guaranteed.
